Clay County Deputies responded to a possible assault at Spencer Livestock Yard.
Upon investigation Clay County Deputies determined that Russell Dean Maras had
entered Spencer Livestock and told to leave. Maras failed to vacate the premises
and initiated violent behavior. Maras was arrested and charged with trespass and
disorderly conduct, both simple misdemeanors.

Details of Arrest: A Clay County Deputy initiated a traffic stop for a traffic
violation and with having prior knowledge that Ferguson had a suspended drivers
license. Upon investigation, it was found Ferguson had consumed alcoholic
beverages. Ferguson was run through field sobriety tests and was placed under
arrest. Ferguson was transported to the Clay County Jail w/o incident. Ferguson
was charged with O.W.I. (2nd), an Aggravated Misdemeanor, Operating a
Non-Registered vehicle, No Insurance, Failure to Have a Valid D.L. and Driving
Under Suspension, all Simple Misdemeanors.

Held in Jail for Other Agency: A traffic stop by a Clay county Deputy on
Saturday, May 4th, 2013, land an Estherville male and female in the Clay County
Jail on traffic, alcohol, interference and violation of protection order
charges.
At approximately 1543 hrs, a Clay County Deputy conducted a traffic stop for a
traffic violation. Upon investigation, it was found the driver, Antonio
Ibarra-Meza, 33, Estherville, Iowa, had a protection order against him with the
protected party being Maria Perez-Busani, 34, Estherville, Iowa. The Deputy made
contact with the female passenger and was given the name of Maricella
Ibarra-Ibarra. Upon further investigation, it was found Perez-Busani had given
the Deputy a false name. Ibarra-Meza was placed under arrest for Violation of a
Protection order and in attempt to direct him to the patrol car, Ibarra-Meza
attempted to pull away. Ibarra-Meza was redirected and placed into the patrol
car w/o incident.
Upon further investigation, it was found there were open containers of alcoholic
beverages in the vehicle. Upon the arrival of Clay County jail staff, Perez-Busani
was taken into custody and was transported to the Clay County Jail w/o incident.
Ibarra-Perez was also transported to the Clay County Jail w/o incident. Perez-Busani
was charged with Interference w/ Official Acts an Open Container, both Simple
Misdemeanors. Perez-Busani was later released on a $300 cash bond. Ibarra-Meza
was charged with, Speeding, Operation w/o Registration, No Insurance, Open
Container, Fail to Maintain Registration Plate, Interference w/ Official Acts
and Violation of a Protection Order, all Simple Misdemeanors. Ibarra-Meza was
held to appear before the Clay County Magistrate. A traffic stop by a Clay
County Deputy on Friday, May 3rd, 2013, lands two Spencer males in the Clay
County Jail on drug charges.
At approximately 1734 hrs, a Clay County Deputy initiated a traffic stop on a
vehicle and upon investigation, it was found the driver, Ty Jackson, 19,
Spencer, Iowa, had been smoking marijuana. Jackson was run through a series of
field sobriety tests and turned over a small quantity of marijuana and drug
paraphernalia to the Deputy. Jackson was placed under arrest.
Upon further investigation, the Clay County Deputy was assisted by the Spencer
Police Department and made contact with the male passenger, Ryan Dodge, 20,
Spencer, Iowa. Dodge admitted to using Jackson’s marijuana pipe to smoke
marijuana in the vehicle. Dodge was placed under arrest and upon search of his
person, was found to be in possession of marijuana and drug paraphernalia.
Jackson and Dodge were transported to the Clay County Jail w/o incident. Upon
arrival at the jail, Jackson was run through a series of tests by a drug
recognition expert to determine whether he was operating the vehicle while under
the influence of drugs. A urine sample was collected and sent to the Department
of Criminal Investigation for further analysis. Jackson and Dodge were turned
over to jail staff for booking charged with Possession of a Controlled
Substance-Marijuana, a serious misdemeanor and Possession of Drug Paraphernalia,
a Simple Misdemeanor. Charges on Jackson for O.W.I. are pending test results

one man after a trespass complaint leads to a pursuit throughout southern Clay
County.
On Tuesday, April 23rd at approximately 1:45pm Clay County Deputies responded to
a Criminal Trespass complaint at 4730 240th Avenue. A man identified as
Christopher Richard Wood, 45, of Webb, trespassed onto the property and
attempted to enter the residence. Wood then left the residence but remained in
the area.
Deputies located Wood in downtown Webb, IA. As a Deputy exited his vehicle and
approached to speak with Wood, Wood ran to his vehicle and fled from the scene
at a high rate of speed. Deputies pursued.
Prompt response from additional Clay County Deputies and Iowa State Patrol lead
to Wood’s apprehension in the 2300 mile of county road B-53.
Wood was taken into custody and charged with four counts of Felony Eluding, two
counts of Reckless Driving, two counts of Careless Driving, two Stop Sign
Violations, four counts of Interference with Official Acts, One citation for
speed, and one count of Criminal Trespass. Wood was released on $5,000.00 bond.
The pursuit is still under investigation and further charges are pending. The
Clay County Sheriff’s Office was assisted by the Iowa State Patrol. Deputies

ACCIDENT DETAILS
Vehicle #1 was traveling northbound on 130th Ave and
stopped at the stop sign at the intersecion of 130th Ave and Highway 18, to make
a left turn. Vehicle #1 states she believed she was at a 4-Way intersection, and
proceeded onto Hwy 18 and oncoming traffic. Vehicle #2 collided with vehicle #1
broadside. The passenger of Vehicle #1 was transported to Spencer Municipal
Hospital for minor injuries. The driver and passengers of Vehicle #2 reported no
injuries, both vehicles were towed from the scene.

possession of a controlled substance and possession of drug paraphernalia.
Achenbach was transported and booked into the Clay County Jail by the Clay
County Sheriff’s Office.

Justin White was driving a red 2005 Kenworth Semi loaded with swine southbound
in the 4300 mile of M-54. White failed to slow for a curve in the roadway and
entered onto the shoulder. The semi tipped on its side and slid into power lines
coming to rest in the roadway. The Clay County Sheriff’s Office was assisted on
scene by Dickens Fire and Rescue, the Iowa State Patrol, Spencer Hospital
Paramedics, Alliant Energy, and citizens of Gillett Grove.

Clay County Deputies were dispatched to a single car, personal injury accident
in the 3500 Mile of 240th Avenue. The vehicle was north bound on M-50 when it
entered the east ditch. Upon entering the ditch the vehicle rolled once causing
approximately $5,000.00 damage to the vehicle. The accident is still under
investigation and charges are pending. The Clay County Sheriff’s Office was
assisted at the scene by the Spencer Police Department, Dickens Fire and First
Responders, Spencer Fire and Rescue, and the Spencer Ambulance.

ACCIDENT DETAILS
Unit 1 was traveling north in the 3900 mile of Clay County road M-50 and was
pulling a homemade farm wagon. Unit 2 was traveling north behind unit 1. The
driver of unit 2 fell asleep and ran in to the rear of unit 1’s farm wagon. Unit
2 rolled approximately one time and came to rest on its tops facing east.

Thursday, April 4th, the Clay County Sheriff's Office arrested Heather Marie
Gustoff, 37, 907 East Milwaukee Street, Spencer, and charged her with making a
false report to a public safety entity.
On January 30th, 2013, while residing at 120 2nd Avenue, Rossie, Gustoff
reported to authorities she was the victim of a domestic assault. During the
investigation, Gustoff made statements to multiple law enforcement agencies
claiming she had been assaulted by Cory Hofmeyer, also of 120 2nd Avenue, Rossie.
In a hearing in Clay County Magistrate Court Thursday, Gustoff testified the
statements she provided to law enforcement related to the assault in January
were not factual. Based on Gustoff’s sworn court testimony, Gustoff was arrested
and taken into custody.
Gustoff was processed into the Clay County jail, charged with a simple
misdemeanor and held pending the posting of bond or an appearance before the

caller advised the vehicle turned east onto B24. A Clay County Deputy located

vehicle in the 3600 mile of 190th Ave. The driver was identified as Clayton Noll
of rural Spencer. Noll conducted several standardized field sobriety tests and

1st Offense a serious misdemeanor and cited for an open container of alcohol.

ACCIDENT DETAILS
Clay County Deputies were called to a two
vehicle accident in the 3300 mile of M-50 at approximately 20:00 on Friday March
29. Upon arrival and investigation, Deputies learned a vehicle driven by Alma
Donkersloot was traveling north when she rearended a Tractor driven by Patrick
Jones. Donkersloot and passenger Carol Baumgarn were transport to the Spencer
Hospital where Baumgarn was treated for a fractured right leg. Jones was treated
and released at the scene. The Clay County Sheriff's Office was assisted by
Dickens Fire and Rescue, Spencer Fire and Rescue and Spencer EMT. Deputies #

Clay County Deputy initiated a traffic stop along Highway 10 in Peterson. As the
vehicle pulled into the alley the driver fled from the vehicle on foot and could
not be located. Upon investigation Deputies determined Gunnerson was operating
the vehicle. Gunnerson was later arrested and charged with Interference with
Official Acts and improper headlights both simple misdemeanors. Gunnerson was
booked without incident and released on bond.
