Early morning arrests in Royal place two Cherokee residents in the Clay County jail on burglary related charges, a major break in a string of burglaries involving more than 10 northwest Iowa counties.

On Sunday August 30th, approximately 4:30am, a Clay County Deputy witnessed suspicious activity and a vehicle parked near Haggy’s bar, 206 Main Street, Royal. After making contact with the two subjects, burglary tools were observed in the suspect’s vehicle and each was taken into custody.

Arrested were Shawn Edward Boger, 25, and Misty Lynn Smith, 37, of 362 East Cedar Street, Cherokee. Both are charged with Attempted Burglary and Possession of Burglary tools, each aggravated misdemeanors, and were held in the Clay County jail on $2000 bond or surety.

As the investigation continued, a search warrant was applied for and granted, allowing searches of Boger’s 1998 Ford pick-up truck, cell phones and residences in Cherokee and Storm Lake. Multiple pieces of property were located and seized for evidentiary purposes, believed to be related to multiple bar burglaries, which have plagued northwest Iowa law enforcement agencies recently.

“This is law enforcement at its basics. Recognizing a problem, developing an idea to combat it, and seeing it through”, said Chief Deputy Brad Hawley of the Clay County Sheriff's Office. He continued, “Our Deputies were specifically watching bars in Clay County because of the high numbers of burglaries in the surrounding areas. The fact is this, Sheriff Krukow and I encourage our Deputies to be active, efficient and aggressive, and that direction paid off in this case. ”

This investigation is continuing and additional arrests and seizures are expected. The Clay County Sheriff's Office was assisted initially by the Spencer Police Department and the O’Brien County Sheriff’s Office, with subsequent assistance provided by the Clay County Attorney’s Office, the Buena Vista, Cherokee and Lyon County Sheriff’s Offices, the Cherokee and Storm Lake Police Departments, and the Iowa Division of Criminal Investigation.

ACCIDENT DETAILS

Unit 1 was traveling west behind slow moving traffic, downhill in the 1100 mile of Hwy. 18. Unit 2 was traveling west in the 1100 mile of Hwy. 18. Unit 2 crested the hill and saw Unit 1 traveling slowly and attempted to slow and struck the rear end of Unit 1. Upon investigation, it was found Williams had a suspended drivers license and no insurance. While conducting a search of Williams, the odor of marijuana was detected and marijuana was located on Williams’s person. Williams was placed under arrest and was transported to the Clay County Jail w/o incident. Williams was released on a $1,000.00 cash or surety bond.

ACCIDENT DETAILS

A 1974 John Deere tractor, pulling an implement, was east bound on Hwy 18, making a left turn onto 200th Ave. Burney, also eastbound, attempted to pass before noticing the tractor’s intention. Burney swerved to avoid contact but was unable to avoid the collision. The impact caused the tractor and implement to enter the east ditch of 200th Ave. The Clay County Sheriff’s Office was assisted by the Spencer Ambulance.

A traffic stop by the Clay County Sheriff’s Office lands two Terril females in the Clay County Jail on drug charges.

At approximately 9:57 p.m., Wednesday, August 19th, 2015, a Clay County Deputy initiated a traffic stop for an equipment violation. Upon approaching the vehicle, the Deputy observed the a female passenger, identified as Sklyee Ferguson, 19, 108 N. 4th Street, Terrill, pulling her hand out of her shirt and smelled an odor of marijuana coming from the vehicle.

Upon investigation, the driver, Joya Salzkorn, 19, 108 N. 4th St., Terrill, Iowa, admitted giving marijuana to Ferguson. As the investigation continued, Ferguson turned over marijuana and drug paraphernalia to the Deputy. Ferguson and Salzkorn were placed under arrest and transported to the Clay County Jail without incident. The vehicle was towed to the Clay County Sheriff’s Office and an application for a search warrant was made.

Salzkorn and Ferguson were each charged with Possession of Controlled Substance-Marijuana, a serious misdemeanor and Possession of Drug Paraphernalia, a simple misdemeanor and Salzkorn also was cited for No Driver’s License, a simple misdemeanor. Salzkorn and Ferguson were each held to appear before the Court if unable to post a $1,000.00 cash or surety bond.

In the evening hours of Thursday, August 20th, 2015, the Clay County Sheriff’s Office executed a search warrant on the vehicle in which Salzkorn and Ferguson were arrested from. Marijuana, drug paraphernalia and prescription drugs were located and seized for evidence. At approximately 12:00 a.m., Friday, August 21st, 2015, a Clay County Deputy met Haylie Gillis, 18, 2702 Sunner Ave. Apt #9A, Spirit Lake, Iowa, at the Clay County Jail reference the search warrant. Gillis was placed under arrest, charged with Possession of Drug Paraphernalia, a simple misdemeanor. Gillis was released after posting a $300.00 cash or surety bond.
This investigation remains active and additional arrests and charges are anticipated.

Details of Arrest: Clay County Deputies received a complaint of a reckless driver north bound from Sioux Rapids, into Clay County. Deputies located the vehicle a short time later, and identified it as a possible intoxicated driver and initiated a traffice stop in the 4700 Mile of HWY 71. Upon futher investigation it was found the driver, Dehler John, was under the influence of alcohol, and had an open container in the vehicle, and operating a motor vehicle without a valid driver's license. John then admitted to stealing the vehicle from a downtown Storm Lake apartment complex. John was transported to the Clay County Jail without incident. The Clay County Sheriff's Office was assisted by the Storm Lake Police Department.

Details of Arrest: A Clay County Deputy initiated a traffic stop for a traffic violation and upon investigation, it was found the driver, Patrick Johnson) had a barred drivers license. Upon placing Johnson under arrest, the Deputy emptied out Johnson's pocket and located a small baggie containing a white powdery substance. Johnson grabbed the Deputy's hands in attempt to take the baggie and during the altercation, Johnson caused injury to the Deputy's hands. Johnson was transported to the Clay County Jail w/o incident. Johnson was charged with Driving While Barred and Assault on a Peace Officer Causing Injury, both Aggravated Misdemeanors, Interference w/ Official Acts Causing Injury, a Serious Misdemeanor, Driving Under Suspension, Failure to File S.R. Insurance and No Insurance, all Simple Misdemeanors. Johnson was released on a $2,000.00 cash or surety bond. This investigation is ongoing and more charges are anticipated.

Wolden was arrested and taken to the Clay County jail where he was charged with OWI 2nd Offence an aggravated misdemeanor and given a warning for failure to use head lamps when required.
