On July 22nd, approximately 2:00am, the Clay County Sheriff's Office was called to investigate suspicious persons in Royal and discovered a burglary had occurred at Frederick's Grocery Store on Main Street. An investigation was initiated and on Monday, July 26th, three persons were arrested in direct connection to the burglary, two additional were arrested on various charges related to the burglary, one person was arrested on an active Clay County warrant and one was arrested related to a stolen vehicle from O'Brien County.

Back and Murphy were apprehended in O'Brien County after leading authorities on a high speed pursuit after stealing a vehicle near Paullina and driving to Clay County where the pursuit began.
All of the adults were placed in the Clay County jail and the juveniles, apprehended and facing criminal charges in O'Brien County, were transported to the YES Center in Cherokee.

The Clay County Sheriff's Office was assisted in the investigation and apprehension of these individuals by the Spencer Police Department, O'Brien County Sheriffs Office, Iowa State Patrol and the Hartley Police Department.

Details of Arrest: A Clay County Deputy observed suspicious activity on the deck of the Rendezvous bar. Upon investigation, it was found that Chapman and Menard were drinking alcoholic beverages after hours on the deck of the bar. Both Menard and Chapman appeared to be intoxicated. After testing both subjects, they were placed under arrest for Public Intoxication and were transported to the Clay County Jail w/o incident.
Menard and Chapman were both charged with Public Intoxication, a Simple Misdemeanor.

INJURIES

A total of 5 adults and 2 children were taken to the Spencer Hospital with non-life threatening injuries.

ACCIDENT DETAILS

Bruns was east bound on 330th Ave and Mielke was north bound on 160th Ave.
They met at the intersection at the same time. The Mielke vehicle then struck Bruns vehicle at that time. Bruns had two other adult passengers, a Terry Henderson of Everly and a Donna Hansen of Everly. Mielke had three other passengers a Jill Mielke and two children all of Graettinger. The Clay Co Sheriff's Office was assisted by the Iowa State Patrol, Everly Fire and Rescue and the Fostoria Fire and Rescue along with Spencer Paramedics.

Details of Arrest: While out on patrol, a Clay County Deputy observed a vehicle speeding and locked him on radar doing 80 in a 55mph zone. During the person to person contact phase of the traffic stop, the Deputy was advised the driver was currently under revocation and did not have a valid drivers license. After talking with the driver, the Deputy could smell alcohol and had the driver do a series of field sobriety test. After the series of test, the driver was arrested for Operating While Intoxicated and transported to the Clay County Jail for processing.

Details of Arrest: At approximately 16:30 hrs the Spencer Communications Center received a phone call from a subject that said that there was a vehicle in the parking lot of the South Park Mall that was being driving by a female subject that did not have a license. The caller did give a name of the driver and the communications center did verify that the female subject did in fact have a suspended license. A Clay County Deputy located the vehicle in question and then stopped it in the Hy-Vee parking lot. The Deputy learned at that time the person that was thought to be driving was a passenger in the vehicle, but the current driver identified as Krista Doll also did not have a valid driver’s license. A check with the Spencer Communications Center showed that Doll’s license was revoked due to an OWI test failure. Doll was then arrested and taken to the Clay County Jail were she was charged with driving on a revoked license a serious misdemeanor. She was held on a $1000 bond. Doll was also cited for not showing any proof of insurance for the vehicle.

He had threaten to come over and catch her at home, and cause her harm, she left the residence immediately, and upon his arrival, no one was at the residence, so he damaged her property and personal items including furniture.

Details of Arrest: A Clay County Deputy initiated a traffic stop for a traffic violation and upon investigation, it was found that Jones had been drinking and was under the legal drinking age of 21. The Deputy ran Jones through field sobriety tests and determined that she was over the .02% b.a.c. law for people under the age of 21. The Deputy advised Jones that she was not under arrest as this was only an administrative action on her drivers license although she would have to be taken to the Clay County Jail for further testing and would then be released. Upon further investigation, the Deputy observed an unusual lump in the front of Jones' shorts and asked her about it. Jones denied having anything in the shorts at first but then handed the Deputy 2 glass marijuana pipes. Jones was then placed under arrest and was then transported to the Clay County Jail w/o incident. Upon further investigation at the jail, it was found that Jones had a baggie of a marijuana inside of her bottom undergarment. Upon completion of testing at the jail, Jones' drivers license was revoked for 60 days for a .02 violation. Jones was charged with Possession of a Controlled Substance-Marijuana, a Serious Misdemeanor, Possession of Drug Paraphernalia, a Simple Misdemeanor, and Possessing Marijuana in a Correctional Facility, a Class "D" Felony.

Details of Arrest: A Clay County Deputy made a traffic stop on a vehicle for speeding in the 100 block of main street in Royal. During the stop the Deputy learned that the driver, Rodney Menhusen Jr. had a suspended drivers license. After further investigation the license plates that were on the vehicle Menhusen was driving did not match the vehicle. Menhusen was then taken into custody and transported to the Clay County jail. Menhusen also had an arrest warrant out of Obrien Co for theft 5th. Menhusen was charged with driving on a suspended license, improper use of registration, and speeding. He was held on bond at the Clay County Jail. He was later released into the custody of Obrien County.

A Check of Kindlespire Park in Clay County lands an Albert City male in the Clay County Jail on drug paraphernalia charges and several others charged with underage alcohol possession.

At approximately 0105 hrs on Friday, the 16th day of July 2010, a Clay County Deputy was conducting a check at Kindlespire Park and noticed a subject take off running and suspicious activity by others. Upon investigation, two 17 year old juvenile males, Webb, Iowa, and, Laurens, Iowa, and Garrett Reed, 19 Albert City, Iowa, and Samantha Hall, 19 Storm Lake, Iowa, were sitting in the picnic table area by the river. The deputy observed beer cans and a strong odor of an alcoholic beverage. The deputy then continued the investigation and observed a dugout through the window of Reed’s truck. Reed was placed under arrest at this time. The two juvenile males were tested and taken into custody for underage alcohol possession.

Upon further investigation, it was found that there was a 16 year old juvenile female from Sioux Rapids, Iowa, a 17 year old juvenile male from Sioux Rapids, Iowa, and 18 year old Kirstyn Jones of Storm Lake, Iowa, were still in the trees. The three subjects came out and the deputy then tested them. The Juvenile male and female were both tested and were taken into custody for underage alcohol possession. The juveniles were transported to the Clay County Jail by the Clay County Jailer. Kirstyn Jones and Samantha Hall were cited into court for Underage Alcohol Possession, a Simple Misdemeanor, and were released.

Reed was transported to the Clay County Jail w/o incident. Upon arrival to the jail, Reed was turned over to the jailer to be booked in. Reed was charged with Underage Alcohol Possession and Possession of Drug Paraphernalia, both Simple Misdemeanors. The 17 yr old juvenile male from, Webb, Iowa was cited into juvenile court for Underage Alcohol Possession and was released to his father. The 17 year old juvenile male from Laurens was cited into court for Underage tobacco Possession (2nd) and was cited into juvenile court for Underage alcohol Possession and was released to his mother. The 17 yr old male from Sioux Rapids, Iowa was cited into juvenile court for Underage Alcohol Possession and was released to his mother. The 16 yr old juvenile female from Sioux Rapids was cited into court for Underage Tobacco Possession and was cited into juvenile court for Underage Alcohol Possession and was released to the custody of the 1yr old male’s mother.

INJURIES

Both Drivers and two passengers received minor lacerations and bruises.

ACCIDENT DETAILS

On Friday Clay County Deputies were called to a two car collision at the intersection of 310th St and 200th Ave. Upon arrival and investigation, deputies learned that driver Cory Climer was traveling eastbound on 310th St when he collided with Michael Howe and two passengers traveling southbound on 200th Ave. All four occupant were transported to Spencer Municipal Hospital where they were treated and released with minor lacerations and bruises. The Clay County Sheriff's Office was assisted by the Iowa State Patrol, Fostoria and Everly Fire and Rescue and Spencer Emergency Response.

INJURIES

Minor injuries to Bergstadt.

ACCIDENT DETAILS

Bergstadt was traveling north bound on Hwy 71 in the 4200 Blk when he crossed over the center line and struck the left rear wheel on the trailer being pulled by Hansen. Hansen who was traveling south bound had moved over to the shoulder of the road to try and avoid the accident but was unable. Bergstadt was taken to the Spencer Hospital where he was treated for minor injuries. The Clay County Sheriff’s Office was assisted by the Iowa State Patrol and the Royal Fire and Rescue Department.

Details of Arrest: Upon the Clay County Sheriff's Office arrival, the Clay County Sheriff's Office conducted an investigation and ultimately found Kilts at Trierweiler's Shop. Kilts was run through several field sobriety tests and was placed under arrest for public intoxication. It was also found that Kilts had lit a newspaper on fire, put it on the front porch deck of the complaints residence, and threatened the complainant and her son that they wouldn't make it through the night. Kilts was transported to the Clay County Jail w/o incident. Kilts was charged with Public Intoxication, a Simple Misdemeanor, and Arson (1st), a Class "B" Felony. Kilts is currently being held on a $25,000.00 cash or surety bond.

Two Spencer females land in the Clay County Jail on charges stemming from a traffic stop on June 19th 2010.

The Clay County Sheriff’s Office conducted an investigation of a stolen registration tag that was being used on a vehicle during a traffic stop in June which resulted in an O.W.I. arrest. Upon investigation, it was found the owner of the vehicle, Jennifer Armstrong, 31, Spencer, Iowa, assisted in the theft of a registration tag from a vehicle at the cardio plus parking lot some time in June. Deputies met Armstrong at her residence and she was placed under arrest and was transported to the Clay County Jail w/o incident.

Upon further investigation, it was also found that Heather Peterson, 33, Spencer, Iowa, was involved in the theft of this registration sticker. Deputies met Peterson at her residence and she was placed under arrest and was transported to Clay County Jail w/o incident. Peterson was cited into court for Theft (5th) and was later released. Armstrong was charged with Interference with Official Acts, Operation w/o Registration, and Improper Use of Registration, all simple misdemeanors. Armstrong was later released on a $300 Cash or Surety Bond.

Rural Dickens man was killed in a grain bin accident Friday morning, ½ mile north of US Hwy 18 on N-14.

At approx. 8:22 am the Clay County/Spencer Communications Center received a 911 call reference a man trapped inside a grain bin full of corn that was being augered out.

When area Rescue crews arrived they were unable to reach the man in the bin. Several holes were cut in the side of the bin and corn removed before they could locate him. The farmer was pronounced dead at the scene by Clay County Medical Examiner, Dr. David Robinson.

The farmer was identified as Doug Sorenson, 65, of rural Dickens.

The Clay County Sheriffs office was assisted on scene by Palo Alto County Sheriffs Office, Dickens Fire and Rescue, Ruthven Fire and Rescue, Ruthven Ambulance, Spencer Ambulance, Clay County Emergency Management, and by family and friends.
