Details of Arrest: A Clay County Deputy conducted a traffic stop on Fitzgerald, who’s driver’s license was suspended. Fitzgerald was placed under arrest and transported to the Clay County Jail. In the jail, Fitzgerald was found to be in possession of a controlled substance. A search warrant was obtained for Fitzgerald’s vehicle and pieces of drug paraphernalia and additional controlled substances were found. Fitzgerald was held on $5000 bond

Seuntiens was northbound in the southbound lane in the 3600 mile of Clay County road N-14 and Nelson was traveling north in the northbound lane. Nelson saw Seuntiens and attempted to slow. Seuntiens failed to yield to Nelson and as it was attempting to re-enter the north bound lane, it sideswiped Nelson.

A check of Groote's drivers license found it was revoked. Groote failed field sobriety tests and was placed under arrest and was transported to the Clay County Jail. The Clay County Sheriff's Office was assisted by the the Iowa State Patrol.

A three vehicle accident Friday morning causes multiple injuries and tied Hwy 18 traffic up for several hours.

Approximately 7:50am, the Clay County Sheriff's Office responded to a three vehicle traffic crash at the intersection of Hwy 18 and 310th Avenue (N14). Upon arrival, a red 1997 Ford F250 pick-up was stopped on Hwy 18, in the eastbound lane, and two vehicles, a 2011 Toyota RAV4 and a 2013 Ford F450, were stopped on the northwest shoulder of the intersection.

The investigation determined Adam Vanderlaan, 26, 522 6th Avenue West, Spencer was eastbound on Hwy 18, driving the red Ford F250. Albino Garcia-Esquivel, 62, 320 West 19th Street, South Sioux City, NE, driving the 2011 Toyota, was stopped facing east on Hwy 18, waiting for traffic before making a left turn onto 310th Avenue. Vanderlaan failed to slow and struck Garcia-Esquivel in the rear, forcing his vehicle into the westbound lane, causing Garcia-Esquivel to be hit by the 2013 Ford F450, being driven by Manuel Garcia, 59, 9140 Carey Road, Lithia, FL. The impacts caused massive structural damage to all vehicles, and Garcia-Esquivel and Vanderlaan were transported to Spencer Hospital with non-disclosed injuries. Garcia-Esquivel was treated and then life-flighted to Mercy Hospital in Sioux City. Vanderlaan was treated and released from Spencer Hospital. Garcia and a male passenger were medically evaluated at the scene and were not transported.

This crash remains under investigation and is being technically investigated by the Iowa State Patrol, and charges are pending the investigation results. The Clay County Sheriff's Office was assisted on scene by the Iowa State Patrol, the Dickens and Ruthven Fire and Rescue units, the Spencer Hospital and Palo Alto County ambulance services, the Iowa Department of Transportation, the Palo Alto County Sheriff’s Office and Bud’s Towing.

Gustin was transported by the Spencer Ambulance to be treated for possible injuries.

ACCIDENT DETAILS

Enderson was traveling west on 370th St., approaching 300th Ave. Gustin was traveling south on 300th Ave., approaching 370th St. Enderson failed to yield to the right of way at the uncontrolled intersection and struck Gustin. Enderson was turned to the south from the impact, fishtailed and came to rest facing south on 300th Ave. Gustin slid into the southwest ditch striking a utility pole and a large shrub and came to rest facing southwest in a farm yard. A short time later, Swart was traveling west on 370th St. and struck a power line from the down utility pole.

May 6, 2016

On April 28th 2016, at approximately 10:00 am, the Clay County Sheriff's Office, with support from the Spencer Police Department, conducted a lock-down and K-9 deployment at the Clay Central-Everly High School. Within the school, the Spencer Police K-9 was deployed to the exterior of student lockers, and did not alert. The Deputies and K-9 handler then conducted outside operations, with the K-9 deployed around vehicles in the high school parking lot and the immediate areas surrounding. The K-9 showed interest in a silver, 2004 Jeep Grand Cherokee, and officers observed drug paraphernalia in plain view within the Jeep.
Deputies made contact with the registered owner, Kyle Tankersley, a student at Clay Central-Everly and Tankersley voluntarily retrieved the drug paraphernalia, was placed under arrest and was transported to the Clay County Jail. Deputies applied for and received a search warrant for Tankersley’s Jeep and upon service, seized additional pieces of drug paraphernalia and a quantity of marijuana. Tankersley was processed into the Clay County Jail, charged with possession of controlled substance-marijuana and possession of drug paraphernalia, and held on a $1000.00 cash or surety bond.
Chief Deputy Brad Hawley stated, “This joint effort between our office and the Spencer Police Department is a great example of the cooperation which exists between all law enforcement agencies in the area.”

A 911 call leads to a rural Spencer man being arrested on various weapons, domestic assault and driving violations.

On Tuesday, April 19th, at approximately 11:00pm, the Clay County Sheriff’s Office was dispatched to the residence of David and Janel Maurer, 4110 225th Avenue, Spencer, for a reported domestic assault and a shot was fired inside the residence. Initially, two Clay County Deputies, two Iowa State Troopers and a member of the Spencer Police Department responded, and established a perimeter and communication with the reporting party. Janel Maurer reported her husband David, had assaulted her and fired a shot from a weapon inside the residence, before leaving. Janel Maurer was directed from the residence and safely secured a distance from the scene.

As officers worked to determine specific events which occurred, David Maurer was located in the 2200 mile of 410th Street, driving a 1988 Caterpillar tractor, and taken into custody without incident. As the investigation continued, it was learned David Maurer had driven from his property in a 2005 Jeep, travelled north and east before crashing the Jeep in a field, landing upside down in a creek. David Maurer was able to extricate himself, and then drove the tractor toward his residence. The residence was secured and firearms and ammunition were seized for safekeeping, pending the disposition of the case.

David Maurer was transported to the Clay County Jail, charged with operating while intoxicated, reckless use of a firearm and domestic assault-impeding airflow, and held to appear before the Court.

“Whenever there is a combination of alcohol and firearms, obviously the danger increases greatly. We are fortunate to have quality agencies in our area to assist our Deputies in these situations and all responding officers worked together toward the common goal of a safe resolution to the incident”, said Chief Deputy Bradley A. Hawley.

Details of Arrest: A Clay County Deputy initiated a traffic stop and upon approaching the vehicle, the odor of marijuana was detected coming from the vehicle. Upon investigation, the 16 year old was found to possess marijuana and was placed under arrest and transported to the Clay County Jail w/o incident. Upon further investigation, marijuana and drug paraphernalia was located in the vehicle and the 17 year old was transported to the Clay County Jail and placed under arrest. The 16 year old was charged in juvenile court for P.C.S.-Marijuana and was released to a responsible adult. The 17 year old was charged in juvenile court for P.C.S.-Marijuana and Possession of Drug Paraphernalia and released to his mother.

Details of Arrest: A Clay County Deputy conducted an arrest warrant check and upon making contact with Freeman, smelled the odor of marijuana coming from inside the residence. The Deputy called for assistance and Freeman attempted to prevent entry by the Deputy. The residence was entered to detain Freeman and secure the residence. Freeman was non-compliant and placed under arrest and transported to the Clay County Jail. A search warrant was applied for and granted. The search warrant was executed with illegally possessed narcotics and drug paraphernalia being located.

ACCIDENT DETAILS

Harmdierks was east bound on Hwy 10 and while attempting to pass, struck Gunnerson’s vehicle. It was determined Harmdierks was intoxicated and placed under arrest. He was charged with OWI 2nd Offense, an aggravated misdemeanor.
